Terms and Conditions
Conditions of use for students of Musical Orbit (referred to as “Musical Orbit”, “we”, “us”, “our”)
You agree not to use any aspect of the Musical Orbit Platform for any purpose other than the purchase and delivery of lessons, webinars or masterclasses. Any other use of the Musical Orbit Platform will be considered a violation of this Agreement which may result in a refusal of access to the Musical Orbit Platform.
We reserve the right to alter or withhold any aspect of the Musical Orbit Platform service without notice.
Having created an account required to use the features offered by the Musical Orbit Platform, you are responsible for maintaining the confidentiality of your account details and password. You are also responsible for all activities that occur in connection with your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to close your account at any time for any reason. Your account is for your individual use only and must be established using accurate information about yourself.
By using by the Musical Orbit Platform, you agree to receive certain communications in connection with the Musical Orbit Platform. We may access such communications if they are sent via the Musical Orbit Platform to monitor use of our services. You can opt-out of any marketing communications we might send you.
Musical Orbit owns and retains all proprietary rights in the Musical Orbit Platform. You may not copy, modify, publish, transmit, distribute, license, perform, display, or sell any content provided by or obtained through the Musical Orbit Platform. Musical Orbit will respond to clear notices of alleged copyright infringement by you. We will promptly terminate without notice the accounts of those determined by us in our sole discretion to be infringing the copyright of any third party.
You will not acquire any rights, title or interest to the Musical Orbit Platform or any content (“Third Party Content”) or material of any kind emailed, uploaded or otherwise submitted by a Student or Teacher to, or through the Musical Orbit Platform or us, or provided by a student or teacher during or in connection with a lesson given through the Musical Orbit Platform. Musical Orbit may remove Third Party Content at our sole discretion and without notice to you.
You hereby agree not to email, upload or otherwise submitted Third Party Content to or via the Musical Orbit Platform which may reasonably be considered by Musical Orbit to be offensive, harmful, false, misleading, illegal abusive, threatening, obscene, profane, offensive, sexually oriented, racially offensive, defamatory or libelous. The upload or submission of such Third Party Content to or via the Musical Orbit Platform will result in the termination of this Agreement.
Any Third Party Content made available through the Musical Orbit Platform, but not directly by Musical Orbit, should not necessarily be relied upon and the relevant authors are responsible for such content. Musical Orbit will not be held responsible for any loss or damage resulting from your reliance on information or other content posted on the Musical Orbit Platform or transmitted to or by any Musical Orbit Platform users.
Any recording of Lessons must be disclosed by the Student to the Teacher and the Teacher’s consent must be obtained in every event. Under no circumstances may Students or Teachers use recorded information from Lessons for anything other than personal use in connection with the purpose of the Musical Orbit Platform. Publication of recorded Lessons on any third-party media hosting website is strictly prohibited and will constitute a breach of copyright and this Agreement.
The Lessons purchased through Musical Orbit Platform are delivered via www.zoom.us. The suggested minimum computer hardware requirements for use of www.zoom.us are provided on the Zoom help pages. We cannot guarantee that this platform will function at any given time using any particular hardware or connection.
Musical Orbit does not supervise Teachers or provide direction to Teachers concerning how to teach Lessons through the Musical Orbit Platform. Teachers are not employees of Musical Orbit. Teachers are not the agents of Musical Orbit, and Musical Orbit is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of Teachers or from any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Musical Orbit reserves the right to audit Lessons for Musical Orbit Platform safety and stability purposes.
Musical Orbit reserves the right to delete your account or limit or deny you access to the Musical Orbit Platform at any time for any reason.
Lessons are offered for sale by Teachers via Musical Orbit Platform and Students may choose to buy them. Purchased lessons cannot be rescheduled except in extreme circumstances and at Musical Orbit’s discretion.
The Students will be charged for the Lesson when the agreed lesson time is confirmed by the teacher. Payment will be taken from the student’s credit card details on the student’s Musical Orbit account, and Musical Orbit will disburse payment to the Teacher after completion of the lesson.
The Student agrees to pay the Lesson price set by the Student’s chosen Teacher via PayPal or on an automatic basis using SagePay if agreed in advance by student and Musical Orbit. In the event of automatic payments being set up, the teacher will inform Musical Orbit each time a lesson takes place, Musical Orbit will take the payment, viaSagePay from the student's agreed card and will inform the student by email immediately each time. Musical Orbit reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.
If a Student cancels a lesson with less than 24 hours notice, is more than ten minutes late to or does not attend a lesson, the Student will not receive any refund for the Lesson.
If a Teacher is unable to provide a Lesson due to a Student’s (i) inadequate hardware or bandwidth or (ii) inappropriate conduct, Musical Orbit generally will not provide a refund to Student, with all such cases handled on a case-by-case basis.
The Student may seek a refund for a lesson cancelled by a Teacher, or the Student may reschedule the lesson with the Teacher via Musical Orbit. Teachers who repeatedly cancel lessons without appropriate notice may have their Musical Orbit Platform access limited/no longer be allowed to act as a Teacher, or may be denied access to the Musical Orbit Platform.
In the instance when a refund is granted, it will be processed within a reasonable period of time. To contact Musical Orbit concerning a potential refund, please contact firstname.lastname@example.org.
You are solely responsible for your interactions with other Musical Orbit Platform users. Musical Orbit makes no representations or warranties as to the conduct of Musical Orbit Platform users and shall not be in any way liable for any conduct of any Musical Orbit Platform user.
You hereby agree to release Musical Orbit from any and all claims, demands or damages of whatever nature to the extent permissible by law arising out of or in any way connected with your interaction with other users of the Musical Orbit Platform.
Musical Orbit reserves the right, in our sole discretion, to change, modify, add, or remove portions of this Agreement at any time.
You agree not use the Musical Orbit Platform to create business of any kind for yourself that takes place outside of the Musical Orbit Platform. You agree not to arrange or participate in any Lessons delivered on-line or on location with any Teacher introduced to you by the Musical Orbit Platform for a period of 6 months following the date of your last lesson with such Teacher delivered via the Musical Orbit Platform.
English law applies to this Agreement and You hereby agree to irrevocably submit to the exclusive jurisdiction of the English courts as regards any dispute, claim or matter arising under or relating to this Agreement.
